Appellant, the City of Houston, appeals the trial courts order that denied the Citys plea to the jurisdiction on quantum meruit claims brought by appellee, Swinerton Builders, Inc. In a single issue, the City contends that Swinerton has failed to show a legislative waiver of the citys immunity from suit, asserting that Swinerton cannot show a waiver of immunity for its quantum meruit claim based on a statute that waives immunity for claims for breach of contract. See Tex. Loc. Govt Code Ann. § 271.152 (Vernon 2006).
